Texas D.A. Won't Prosecute Alleged Braindumper
Judge orders assets returned; Microsoft considering civil charges.

4/22/2004 -- The longest-standing criminal investigation of an alleged
braindumper has come to an end without any charges being filed.

Almost two years ago, San Antonio police seized the business and personal
assets of former TestKiller.com and TroyTec.com owner Garry Neale during a
criminal investigation of a complaint made by Microsoft alleging that he
sold Microsoft certification exam questions, in violation of Texas theft of
trade secret statutes.


Now, Neale's assets -- including $408,566.84 from various bank accounts
along with business assets and personal items such as a truck,
collectibles, children's video games and a refrigerator -- have all been
returned to him by court order. The Bexar County District Attorney's Office
has also publicly declared that it no longer intends to criminally
prosecute Neale.

Much as I hate "Brain Dumpers"...I still find it hypocritical to punish the
purveyors ... while allowing the purchasers/users to go free, actually
rewarding them, since they are the ones getting the inflated titles.

The "holier than thou" assumption that diplomas are automatically superior
to Certifications is also ridiculous. Attending a four year institution
conveys no more sanctity upon a degree, than does attending WestPoint, or
any military academy make all its graduates "gentlemen". Scandal, cheating,
fraud, abuses and incompetence are rampant in all professions. This will
only get worse, as long as the definition of success is narrowly defined as
anything...except manual labor (the "arts" being excluded, even though most
are manual labor within the definition of the term).

Why, you ask, am I bringing up this old chestnut...just because!

Maybe, just a little bit, to say that all crimes are not equal and many
times the crime of the day is weighted way out of proportion to its actual
harm. A bad doctor, lawyer, airline pilot, judge or military officer...is
capable of causing much more damage to society, over the live of his sordid
career, than most certified system jockeys. There is something self limiting
about certifications. It is performance based and fleeting in its
usefulness. The credentialed and awarded professions are subjective and
easily camouflaged incompetence with situational exigencies. Let's work
toward Peer review.
