It's an ALT group. He can do whatever he wants. Anyway, the site is not

Spam is defined by quantity not content.
One off-topic message is just an off-topic message. It may be
obnoxious but it isn't spam, even if it sells something.
A substantially-identical message that is posted to 20000 different
newsgroups is spam, even if it doesn't sell anything, and even if it
is on-topic in those newsgroups. (Unlikely!)
Google for "Breidbart Index" for more details.
Spamming will get you booted from most ISP, even in ALT groups. I
haven't checked to see if the original poster sent enough messages to
be officially spamming. If he did then complain to whoever hosts the
spamvertised website and ask them to shut it down.
There is a loophole around the Breidbart Index. You can put a short
advertisement in your sigfile and then post thousands of different
on-topic messages to newsgroups, without spamming. See the article
