Can I file a Lawsuit?

| I dont plan on suing but just want to know if I can or can not.
As usual I check the online job bank for IT openings frequently. And to my surprise I came across a Network Specialist job, which was in a form of a contract. So I emailed them my resume and was now waiting for their reply, if they were interested that is.
Now, my cousin works at another company which is basically a IT call center. There were a few openings there and he gave them my name and number (I had told him to hook me up whenever they have any openings).
The company that my cousin works at phoned me and asked me to come in to write a computer exam. I came in the next day and wrote the exam and passed it. After that they told me that they were not taking any interviews today but they will contact me this week for sure. So now I was waiting for their call.
The first company I applied to also phoned me that week and asked me to come in for an interview. So I came in the following day which was a friday and sat through the interview. And like always they said if we are interested, we will contact you on Monday.
Now comes Monday and I dont get any calls from either company, so I wait till tommorrow. Now I get calls from both companies back to back. The first one I applied to liked my interview and IT skills and said to come in tommorrow for a Security test (some government papers). So basically I got the job. The next company where my cousin works at phoned me and asked me to come in for an interview tommorrow as well (same time I had to go to the first company to write my security test). I told them I would be busy tommorrow and if they could reschedule to another time (I said that because if something did go wrong at the first company, I could always come back here). The person there forwarded me to the person who was in charge of interviewing and I left her a voice message. So that was that, I finally got a good job at the first company where I applied to.
Now comes Wednesday, and I go write the security test for the government. And after that, they sent me home and said they would contact me and let me know when I could come in for work.
Thursday, Friday, Monday - Thursday rolls by and still no call from them. So I phoned them on Friday (May 16th) and asked for the person who interviewed me (this is the person who was suppose to contact me), the secretary said that he was not in so I left a message. Next friday comes by (May 23) and still no calls. So I phoned again and the same thing happened, person was not there and a I left a message.
Now yesterday I phoned again and the same thing happened. So I phoned again today and the person was not there again, this time the secretary asked me if this was urgent and I said yes, so she forwarded me to the manager. I told him what had happened and he said that we did not get the contract and laid off all the IT people.
Now I dont have any job and the place where my cousin works at is now full. The person at my cousins work who I had left a message for never called me back.
I just want your opinions on to what I should do about the first company, can I sue them or just let it go?

| well , anybody can file a lawsuit if you've got the money to waste......
the process usually starts with consulting a laywer to see if he'll laugh in your face or persue a case. !
looks like you're a victim of bad timing ....
btw there is no expectation of employment unless you've got a contract so you'd have to prove discrimination.

| It sounds very fustrating! If I were you, i'd let it go. I hate to be blunt, but its the only way for me to get my message through.
The company that never called you back never made any promises that they will hire you and you didn't sign a contract. You had a 50/50 choice and unfortunatly made the wrong one. Its not no ones fault but your own. Accept it. Move on. Better opportunities will come your way. Sueing is not an option. I don't think any lawyer woud take you serious, but then again, this is America. | |

| I'd just take it on the chin and let it go - why go through the stress of a lawsuit for a job you never got formally offered??
Can you really sue for this sort of thing in the states?
Hopefully just writing the post will have helped you calm down, it may help to write to whoever interviewed you and explain that you really do want to work for them and is there anything they can do??
I really hope the UK never goes this way, though with all the adverts we get now, "Have you had an accident in the last 3 years", "Have you ever worked down a mine and have vibrating fingers" etc I suspect we eventually will.

| Sue them for what? For not returning your phone call, and then saying that the positions are full? LOL. It's not their responsibility if you don't have a job, or missed a potential one because of them. Two words "unemployment office". There's obviously nothing criminal as to what he did, so the chances of suing based on criminality are out the window, which BTW you can't do anyways. About the only option you have is a civil lawsuit, and the preponderance of the evidence lies in your hands. All I have to say that is good luck. You're on your own with that one. I don't think anybody in their right mind would represent you. So I guess what I'm trying to say is you don't have a case. | |

| Currently working for a lawfirm. I doubt we'd take your case. Discrimination is tough to prove. | |
