Can anyone advise on the legal position when downloading MP3's? Someone was telling me recently that you can't be sued for downloading them, only for sharing yours with other people. Is this correct? I always thought it was the other way round.

You can be sued for both. However they are looking for the sharers at this time. It's easier to find sharers then leechers.

So if everyone becomes a leach and quits sharing for fear of getting sued shouldn't that more or less shut the system down? Or is it that some people are too stupid to realize that sharing is illegal, or that they are even sharing, or is it that they just do not care?

The RIAA can sue all they want in the US. However I hope they know the laws other countries have. You'll need a South African attorney to go after that sharer from Johannesburg.

They are bound by US law which makes other foreign sharers *almost* immune unless they are willing to pursue that person in their home country. Unlikely though because of the cost, you'd have to be a really big catch like someone with over a 10 million files.

If you live outside the US and Canada I would consider you OK.

Is this the same for both USA and UK. I havn't really looked at any of this but am sure i heard the other day how it doesn't affect the UK at this time but will very shortly. They are trying to cut it out but not yet made illegal like USA.

Why? Do you seriously think that countries other than yours don't have their own music industries and copyright laws?

Yea, but the problem is you can't sick a US attorney on a guy from the UK. Different laws. You need a British attorney for that.

Lawyers here can only practice where they are admitted to the bar.

Eh??? wtf are you talking about? Who said anything about a US lawyer, RIAA, or any other American organisation?

Why would say the British/French/Japanese music industries need any of them?

The RIAA does have international counter parts like the MIAC in Canada.

I read in USA Today (Today 12/4/03) that the RIAA was NOT allowed to pursue file sharers in Europe. I assume this means the UK as well. Page 1B.

I misspoke. The article simply said that the lawsuits have only increased interest in illegal file-swapping in Europe, where no lawsuits have been filed, not that they could not sue Europeans.

Yea know, if cd prices are what they are now. I would seriously buy them. However $20 for 3 good songs is not right.

I have had success with IPOD for Windows for .99 per song, but it sucks they are in protected MP3, which makes it hard to burn for a regular CD player. I mean I have a good MP3 player but the car uses CD. Oh well. Someone will find a way to crack those and have shareware available soon.

Are there places on the net where one could go and pay a price for the priviledge of downloading a piece of music for one's own use, with the understanding that the purchaser was going to apply the file to some type of media, that is, a cd or dvd? I know that earlier it was raised as a possible solution that should satisfy everyone, the RIAA would get their money, the artists would get their money, and the users would get the songs they want at a price they'd be willing to pay without having to pay for stuff they don't want. Has that ever been brought to pass? If it has, then all those people who are ripping music because they didn't want to buy whole cd for three songs seem to have lost the wind in their sails, haven't they? All of a sudden it becomes a matter of wanting something for nothing. Eh?

Having checked this out I can now exclusively reveal that downloading MP3's is completely within the boundaries of UK law and you cannot be sued for doing so. You can however be sued for sharing music online.
