Having had a loss in his family might explain why he himself was away from business for a few days. However, in a real business, if you can't attend to things yourself, you see that it gets done through a delegate. He should have at least had SOMEONE attending to the incoming mail and requests stating that Mr. Haskins has had a death in the famiy and will be unavailable until such-and-such a date. And then, instead of immersing himself in his loss, he should have taken care of business. That's what business people do. Owning a business isn't like having a job. When you have a job you make a certain comittment to your employer. When you have a business you take your customers' trust when you take their order, and you have an obligation to fulfill that trust regardless of your personal life. Most customers would understand a devastating loss, if they get the opportunity to know of it, and would be patient until the business owner was again able to care for his customers. But no customer should feel ignored. And when technical difficulties make it impossible to fulfill the contract, that's the chance the business owner takes when he embarks on the enterprise, and he must be prepared to make the customer whole either in product and/or service or in money. That's contract law, and regardless of WHY he broke it, he broke it, and he broke the trust of his clients.
