Author Clarification on selling items

Recently, someone offered to sell CBT nuggets in one of the forums, and was told by several people that it was illegal. That started me to thinking about what is legal and illegal when it comes to computer instructional aids. It seems like we encourage the resale of used books, like the All in One books and others, but people really got angry with the poster who offered the CBT Nuggets. And, I've seen other negative reactions when people have suggested reselling practice tests. I'm trying to sort out the differences...it seems they are all copyrighted material, so I don't think it's just being copyrighted.

Please understand that I'm just asking for clarification....I'm not encouraging it either way....but would appreciate input about this issue.

Reselling practice tests, are worthless. You are basically saying you paid for a product to help you pass, now you have no more use for it.
Also it's copyrighted. You have to be assured you are getting the real thing and not a copy of it.
If you're selling a product, i think it's fine. Put it on an auction. And maybe we can help the person out.

I think the main difference comes down to licensing. Books are copyrighted, however, they are not licensed. Therefore, you can sell a used book and not violate any laws. Software usually comes with a license. In almost all cases, that license in non-transferrable, which means selling the software to someone else does not grant that person a license to use the software. This is illegal.

Thanks Pavlov.....I hadn't thought about the licensure aspect, only the copyright issue. I appreciate the clarification.

She says "thank-you". And believe me if she weren't so cute there were a number of times over the past 10 years that she would have been dead! Like the day she decided the living room couch looked yummy, or the time she jumped out a window to catch the skunk that was sauntering through HER backyard! Oh, but how I love her so. She's is part shepherd and part Shiba Inu.

LOL, Pavlov, and I thought I was the only one! I had an 80 lb. Belgium Shephard who went through the french doors after a squirrel at 6am Sunday morning. I don't think very clearly so early in the AM, especially when I've been woken up suddenly with a hangover. I must have spent 15 minutes running around behind the dog cleaning up the blood on the floor before thinking to to grab him and make him stop moving!

At least the time he went after the chicken in the front yard he went through the DOOR.
